§4 Products and orders
Nature of the products: All La Opalia Products are made by hand after the order is placed. Each piece is unique and is created especially for the Customer.
Product information available in the Shop does not constitute an offer within the meaning of Article 66 of the Civil Code, but an invitation to conclude a contract (Article 71 of the Civil Code).
Orders can be placed via the website 24 hours a day, 7 days a week.
After placing an order, the Customer receives an automatic confirmation of receipt of the order at the email address provided. The Sales Contract is concluded when the Customer is sent confirmation that the order has been accepted for processing.
The Seller reserves the right to refuse to fulfil an order in the event of:
- unavailability of the materials needed to make the Product,
- the Customer providing false or incomplete information,
- lack of payment within the specified time.
§5 Prices and payments
Prices in the Shop are gross prices in Polish zloty (PLN) and include VAT at the applicable rate.
The Seller reserves the right to change Product prices; a price change does not apply to orders already placed and confirmed.
Available payment methods:
- BLIK
- Payment card (Visa, Mastercard and other cards supported by the payment operator)
- Apple Pay and Google Pay
- Link (card saved in the Stripe Link service)
- Klarna (deferred payment or instalments, on Klarna's terms)
- Przelewy24 (when the method is shown in the order form)
Payments are processed by the payment operator Stripe Payments Europe Ltd. The methods available for a given order are shown in the order form.
Order processing begins once the payment has been credited to the Seller's account.
If payment is not received within 5 working days of placing the order, the Seller may cancel the order.
§6 Lead time and delivery
Because every Product is made by hand, the order lead time is 7–14 working days from the moment the payment is credited. The Customer is informed of the expected completion date in the order confirmation.
Delivery is made by a selected courier company or Poczta Polska within Poland.
The delivery cost is shown in the order summary before the order is placed.
Delivery within Poland is free of charge.
The Seller sends the Customer the parcel tracking number promptly after dispatch.
The Customer should check the condition of the Product upon receipt. If the parcel shows mechanical damage, it is recommended to draw up a damage report in the presence of the courier.
§7 Right of withdrawal
A Consumer who has concluded a distance Sales Contract may withdraw from it within 14 days without giving any reason and without incurring any costs other than those specified in this section. Sole traders with consumer rights have the same right.
The period runs from the day on which the Consumer, or a third party other than the carrier indicated by the Consumer, takes physical possession of the Product. If an order covers several Products delivered separately, the period runs from taking possession of the last of them. To meet the deadline, it is enough to send the declaration before it expires.
To withdraw from the contract, simply send a statement by email to kontakt@laopalia.com or by post to the Seller's address. You may use the model form in Annex 1, but this is not obligatory. The Seller will promptly confirm receipt of the statement by email.
Returning the Product and refunds:
- The Consumer sends the Product back to: Magdalena Pawłowska La Opalia, ul. Klinkierowa 1/46, 02-237 Warsaw, Poland, no later than 14 days from the day of withdrawal.
- The Consumer bears the direct cost of returning the Product.
- The Seller refunds all payments received, including the cost of delivery (except for any additional costs resulting from the Consumer choosing a delivery method other than the cheapest one offered by the Shop), without undue delay and no later than 14 days from the day the withdrawal statement is received.
- The refund is made using the same means of payment that the Consumer used, unless the Consumer expressly agrees to a different method that does not involve any costs for them.
- The Seller may withhold the refund until it has received the Product back or the Consumer has supplied proof of having sent it back, whichever is earlier.
- The Consumer is liable for any diminished value of the Product resulting from handling it beyond what is necessary to establish its nature, characteristics and functioning (e.g. wearing it beyond trying it on, washing it, removing the label). The Product may be examined and tried on as it would be in a physical shop.
• a Product made to measurements provided by the Customer (e.g. a dog sweater fitted to the back length or chest girth provided),
• a Product in a colour, size, length or pattern outside the Shop's standard range, agreed individually with the Customer,
• a personalised Product (e.g. with initials or lettering).
The Seller clearly informs the Customer that a given Product is an Individual Product before the order is placed (in the product description, during checkout or in individual arrangements) and confirms this in the order confirmation email.
Products ordered in a standard size and colour available in the Shop, although made by hand only after the order is placed, are not Individual Products and the right of withdrawal applies to them in full.

§8 Complaints (non-conformity of goods with the contract)
The Seller is liable to Consumers and sole traders with consumer rights for the conformity of the Product with the contract under Chapter 5a of the Consumer Rights Act. For other Customers, the provisions of the Civil Code on statutory warranty apply.
If the Product does not conform to the contract, the Consumer may request its repair or replacement. If repair or replacement is impossible or would involve excessive costs, the Seller has refused to bring the Product into conformity or has not done so within a reasonable time, the non-conformity persists despite an attempt to remedy it, or it is so serious that it justifies doing so without prior repair or replacement, the Consumer may declare a price reduction or, where the non-conformity is not minor, withdrawal from the contract.
Complaints can be submitted by email to kontakt@laopalia.com or by post to the Seller's address. To help us handle it, please include:
- the order number,
- a description of the non-conformity and the date it was discovered,
- photos documenting the defect (if possible),
- the Customer's request.
The Seller will respond to the complaint within 14 days of receiving it. Failure to respond within this period means the complaint is accepted.
If the complaint requires the Product to be sent back, the Seller covers the cost of return and redelivery.
The Seller is liable for any non-conformity of the Product that existed at the time of delivery and becomes apparent within 2 years from that time.
§9 Out-of-court dispute resolution
The Consumer has the right to use out-of-court complaint handling and redress procedures. Detailed information is available on the website of the Office of Competition and Consumer Protection (uokik.gov.pl). In particular, the Consumer may:
- refer the matter to the permanent consumer arbitration court operating at the Trade Inspection,
- use mediation conducted by the Trade Inspection,
- refer the matter to the district (municipal) consumer ombudsman,
- in disputes with a trader from another EU country, ask the European Consumer Centre for help (konsument.gov.pl).

§10 Personal data protection
The controller of Customers' personal data is Magdalena Pawłowska, conducting business under the name Magdalena Pawłowska La Opalia (kontakt@laopalia.com). Detailed information on the processing of personal data can be found in the Privacy Policy available at laopalia.com/polityka-prywatnosci.
§11 Final provisions
Matters not covered by these Terms and Conditions are governed by Polish law, in particular the Consumer Rights Act of 30 May 2014, the Civil Code Act of 23 April 1964 and the Act of 18 July 2002 on the provision of electronic services.
The Seller reserves the right to amend these Terms and Conditions for important reasons. Customers will be informed of any change 30 days in advance. Amendments do not affect orders placed before the date the change takes effect.
Any disputes between the Seller and a Customer who is not a Consumer will be settled by the court having jurisdiction over the Seller's registered office.
These Terms and Conditions enter into force on 19 October 2026. Orders placed earlier are governed by the Terms and Conditions in force on the day the order was placed, except that provisions more favourable to the Consumer also apply to those orders.
